HauptbeschreibungDas Buch erzählt von den paradoxen Anfängen des Völkerrechts im 19. Jahrhundert und von den zweideutigen Beziehungen, die es zum europäischen Kolonialismus unterhielt. Im ideellen Rahmen einer weiterhin einheitlich gedachten internationalen Rechtsordnung suspendierte der Westen die Anwendung des Völkerrechts Asien und Afrika gegenüber und vertraute auf das Konsular- und Kolonialrecht. Die neue juristische Wissenschaft stellte sich selbst als historisch, christlich, systematisch und positiv dar. Sie erhob sich zur Maßeinheit der zivilisierten Welt und machte aufgrund ihrer christlichen Wurzeln eine universale Berufung geltend. Dies sollte die Grenzen des Abendlandes überwinden und die Unterschiede zwischen uns und den anderen ausgleichen - und produzierte diese zwangsläufig selbst.
This book relates the paradoxical origins of 19th century international law and the ambigous relations it kept with european colonialism. Within the framework of a conception of an international law furthermore conceived of as unified and homogenous, the western nations suspended the application of international law to Asia and Africa, relying instead on extant consular and colonial law. The new juridical science presented itself as historical, christian, systematical and positive. It ennobled itself as being the yardstick of a civilized world and claimed universality because of its christian roots. While all this was intended to transcend the barriers of the old world and balance the differences between "us" and "they", it inevitably succeeded only in producing what it meant to do away with. less
