HauptbeschreibungDas Ziel dieser Schrift ist es, die strafrechtliche Zurechnung als die Bestimmung der deliktischen Bedeutung eines Verhaltens zu begreifen: Der Sinn des Verhaltens als eines Normwiderspruchs vermittelt zwischen dem Sinn der Norm und dem Sinn der Strafe. Norm, Normbruch und Strafe werden als kommunikative Sequenz dargestellt. Manche Teile des hier vorgetragenen Gedankengangs hat der Verfasser seit Jahren oder sogar Jahrzehnten in nicht wenigen Arbeiten vorgestellt; deren Zugehörigkeit zu einem System soll an dieser Stelle demonstriert werden.
To conceive of penal attribution as a designation of the delict-related meaning of a given behaviour is the objective of this essay. The meaning of this behaviour taken as contradiction of a norm mediates between the meaning of the norm and the meaning of penalty. Norm, contradiction and penalty are shown as a communicative sequence. Parts of this line of thought have been introduced by the author in several papers over the past years; this book is meant to serve as a demonstration of the fact that they belong to a system.
