The Shaming of Sexual Offenders
By: McAlinden, Anne Marie
Published by: Hart Publishing, Ltd

Sex offenders, particularly those who offend against children, feature prominently in contemporary law and order debates. Child sexual abuse is a small component of the broader category of 'gendered and sexualised violence' which causes significant trauma for victims yet continues to evade conventional approaches to justice. This is evidenced not only by the low number of prosecutions, due mostly to low levels of reporting and evidential difficulties at trial, but also by the failure of the justice system to prevent re-offending, largely due to the limited availability and effectiveness of prison treatment programmes. Following Braithwaite's dichotomy of 'reintegrative' and 'disintegrative' shaming, this book argues that contemporary popular and state-led responses to the risk posed by sex offenders are largely disintegrative in nature. At best, the offender may be labelled, stigmatised and ostracised from the community, while at worst, he may be subjected to violence and vigilante action and ultimately return to offending behaviour. The failure of these retributive responses means there is considerable scope for exploring alternative forms of justice and their potential for improving the outcome for victims, offenders and communities affected by sexual offences. This book examines the controversy of whether restorative justice can be applied to child sexual abuse as one of the most intractable of contemporary societal problems, and if so, what special considerations might apply. Although restorative schemes with sex offenders are in short supply, a few initiatives have developed in Canada and parts of the United States which have effected significant benefits in 'reintegrative shaming.' The book examines whether such ad hoc schemes may be of general application with child sexual abuse and whether they may be implemented on a more holistic basis. more...

Social Dynamics of Crime and Control
By: Karstedt, Susanne (ed.); Bussmann, Kai (ed.)
Published by: Hart Publishing, Ltd

This book assembles essays by leading scholars in their fields of criminology and socio-legal studies. John Braithwaite, John Hagan, Jack Katz, Nicola Lacey, Michael Levi, Joan McCord, Dario Melossi, Steven Messner and Richard Rosenfeld explore new directions in contemporary theorising about the impact of social and cultural dynamics on crime and social control. These essays have in common that they transcend disciplinary boundaries by combining criminological and socio-legal perspectives; in so doing they bring fresh perspectives to the analysis of crime in market societies and in the global market place. The authors do not share the apocalyptic and dramatic predictions of rising crime rates, but are aware of the 'double movement' of social change and the counteracting forces that emerge in its course. These essays promote an integrative perspective that bridges the gap between etiological criminology and a constructionist approach as well as between explanatory and normative theory. more...

Social Justice
By: Capeheart, Loretta; Milovanovic, Dragan
Published by: Rivergate Books

An eye for an eye, the balance of scales—for centuries, these and other traditional concepts exemplified the public’s perception of justice. Today, popular culture, including television shows like Law and Order, informs the public’s vision. But do age-old symbols, portrayals in the media, and existing systems truly represent justice in all of its nuanced forms, or do we need to think beyond these notions?. In Social Justice: Theories, Issues, and Movements, Loretta Capeheart and Dragan Milovanovic respond to the need for a comprehensive introduction to this topic. The authors argue that common conceptions of criminal justice—which accept, for the most part, a politically established definition of crime—are too limited. Instead, they show the relevancy of history, political economy, culture, critique, and cross-cultural engagement to the advancement of justice. Drawing on contemporary issues ranging from globalization to the environment, this essential textbook—ideal for course use—encourages practitioners, reformists, activists, and scholars to question the limits of the law in its present state in order to develop a fairer system at the local, national, and global levels. more...

Sociology of Crime, Law and Deviance, Volume 2
By: Ulmer, J.T.
Published by: JAI Press

Sociology of Crime, Law and Deviance is an annual series of volumes that publishes scholarly work in criminology and criminal justice studies, sociology of law, and the sociology of deviance and social control. These are very broad topics, and the series reflects this breadth. The series includes theoretical contributions, critical reviews of literature, empirical research, and methodological innovations. The series especially showcases "big picture" pieces that review and critically reconceptualize what is known and what remains to be understood about broad directions of research and theorizing about crime, justice, law, deviance, and social control. In addition, the series showcases a diversity of methodological approaches. Volume 2 demonstrates such methodological diversity by presenting quantitative studies, ethnographies and discourse analyses. Through an application of these methodologies, the authors examine sanctions, crime and fear and legal and social control organizations and processes. The volume concludes with four chapters contributing to theory development. more...
