Multiple Stressors
By: Mothersill, Carmel (ed.); Mosse, Irma (ed.); Seymour, Colin (ed.)
Published by: Springer

This workshop proceedings aims to address the complex issue of multiple stressors (pollutants) in the environment. This is becoming a major issue now that virtually every region of the world is polluted. This is true even of "pristine" arctic environments where there are no humans, because chemicals and radiation circulate globally, do not respect international boundaries and accumulate in animals, plants and soils everywhere. There are huge problems, both scientific and politico-legal in managing multiple pollution. These range from issues with identifying cause in the legal sense, when cause may be multifactorial, to issues with understanding the subtle interplay of pollutants at the biological level. The scope of the workshop was therefore very wide and multiple disciplines were represented, including economists, lawyers, and ethicists in addition to scientists. Among the scientists, there was a careful blend of those dealing with the practical problems on the ground, and the more theoretical people who want to understand the mechanisms of interactions between various pollutants especially when all are by themselves present at sub-toxic concentrations. The aim of the workshop was to try to identify the issues and to propose a way forward which could at least start to address the issues in a logical way. more...

The Philosophical Foundations of Environmental Law
By: Coyle, Sean; Morrow, Karen
Published by: Hart Publishing, Ltd

Legal regulation of the environment is often construed as a collection of legislated responses to the problems of modern living. Authors conclude, however, that environmental law must be understood as the product of sustained reflection on fundamental moral questions about the relationship between property, rights and nature. more...

Planning and Environmental Protection
By: Miller, Chris (ed.)
Published by: Hart Publishing, Ltd

This collection of essays examines the roles which land use planning can play in the protection of the environment. The subjects covered range from traditional concerns like pollution, nuisance and contaminated land to biodiversity and the pursuit of sustainable development, which forms the defining element of current environmental policy across the European Community and in most other developed economies. Environmental assessment is discussed, along with the succession of public law actions (Twyford Down included) by environmental activists which were necessary to convince the English courts of the full implications (and the ‘direct effect’) of the EC Directive 85/337. The later chapters become progressively more concerned with the planning system as the forum of negotiation and more participatory approaches (as distinct from fiscal instruments and command and control regulation) to encouraging sustainability. The contributors represent a variety of academic disciplines (law, geography, planning, environmental management) offering complementary insights into the planner's role in allocating land uses so as to minimise waste generation and energy consumption as well as maximising local amenity. more...

Pollution and Property
By: Cole, Daniel H.
Published by: Cambridge University Press

Solutions to environmental problems depend on impositing private-, common-, or public-property rights in natural resources. Who should own the resources: private individuals, private groups of 'stakeholders', or the entire society (the public)? Cole argues that no single property regime works best in all circumstances. Environmental protection requires multiple regimes. more...

Property and The Human Rights Act 1998
By: Allen, Tom
Published by: Hart Publishing, Ltd

By giving further effect to the European Convention on Human Rights, the Human Rights Act 1998 has had a significant effect on property law. Article 1 of the First Protocol to the Convention is particularly important, as it protects against the interference with the enjoyment of possessions. Compulsory acquisition, insolvency, planning, taxation, environmental regulation, and landlord and tenant laws are just some of the fields where the British and European courts have already had to assess the impact of the Protocol on private property. The Human Rights Act 1998 also restricts the scope of property rights, as some Convention rights conflict with rights of private property. For example, the Article 8 right to respect for the home has been used to protect against environmental harm, in some cases at the expense of property and economic rights. This book seeks to provide a structured approach to the extensive case law of the European Court of Human Rights and the UK courts on these issues, and to provide guidance on the direction the law is likely to take in future. Chapters cover the history and drafting of the relevant Convention rights, the scope and structure of the rights (especially Article 1 of the First Protocol), and how, through the Human Rights Act 1998, the Convention rights have already affected and are likely to affect developments in selected areas of English law. more...

Resource and Market Projections for Forest Policy Development
By: Adams, Darius M. (ed.); Haynes, Richard W. (ed.)
Published by: Springer

Long-range models that include product and resource detail are essential to meaningful analysis of both industry and resource sustainability. Taking this as its central argument, this book provides essential reading to anyone interested in projecting the future of either the forest products market and/or the forest resource conditions. It is aimed at policy makers, model builders, researchers and graduate students who are building or using forest sector models, as well as at forest industry managers and analysts. While focusing on a specific modeling system ??? the US Timber Assessment models ??? the authors highlight the general elements that might comprise a forest-sector market model of any country or region. Approaches to policy analysis are also general and equally applicable to both national and multi-national forest policy development outside the US ??? particularly in relation to on-going efforts to formulate national programs of sustainable forestry. The text provides literature surveys on relevant modeling issues and policy concerns, and demonstrates the application of the modeling system using a ???base case??? 50 year projection and a small set of scenarios to illustrate, for example, the effects of changes in public harvest policies, global change, variations in investments in silviculture, and globalization. Darius Adams and Richard Haynes are widely recognized as leading experts in the forest sector modeling field. more...

Rethinking Voluntary Approaches in Environmental Policy
By: Sullivan, R.
Published by: Edward Elgar Publishing, Inc.

Voluntary approaches, such as corporate codes of conduct, have been widely advocated as alternatives to traditional approaches to environmental regulation. Yet concern remains that companies cannot be trusted to police themselves and that many of the putative advantages of self regulation, such as reduced cost and increased flexibility, have not been realised in practice. more...
