Regulating Financial Services and Markets in the 21st Century
By: Ferran, Eilis (ed.); Goodhart, Charles (ed.)
Published by: Hart Publishing, Ltd
The essays in this work offer a high-level examination of the most important issues facing financial services regulation, and the far-reaching effects of the Financial Services and Markets Act 2000 on the UK financial sector in the context of rapid global change. Taking an interdisciplinary approach the book includes contributions by many distinguished academic authorities on the law and economics of regulation, and also some of the most influential practitioners, regulators and policymakers. As such it provides an authoritative analysis of the underlying issues affecting the broad development of financial services regulation: the objectives of regulation, the responsibilities of the regulated community, the accountability of regulators, the regulation of electronic financial markets and the impact of stock market mergers, regional regulation within Europe, and the development of global financial regulation.

Regulation
By: Ogus, Anthony
Published by: Hart Publishing, Ltd
This is a reprint of Anthony Ogus' classic study of regulation, first published in the 1990s. It examines how, since the last decades of the twentieth century there have been fundamental changes in the relationship between the state and industry. With the aid of economic theory Anthony Ogus critically examines the ways in which public law has been adapted to the task of regulating industrial activity and provides a systematic overview of the theory and forms of social and economic regulation. In particular, he explores the reasons why governments regulate, for which, broadly speaking, two theoretical frameworks exist. First 'public interest' theories determine that regulation should aim to improve social and economic welfare. Second, 'economic' theories suggest that regulation should aim to satisfy the demands of private interests. The book also looks at the evolution of the forms of regulation in Britain, extending to the policies of privatization and deregulation which were so characteristic of the period. The author skilfully evaluates the advantages and disadvantages of the different forms of regulation, particularly in the light of the two theoretical frameworks, but also by involving an analysis of how firms respond to the various kinds of incentives and controls offered by government. A significant feature of the book is its analysis of the choices made by governments between the different forms of regulation and the influence exerted by interest groups (including bureaucrats) and EC law.

The Regulation of Unfair Commercial Practices under EC Directive 2005/29
By: Weatherill, Stephen (ed.); Bernitz, Ulf (ed.)
Published by: Hart Publishing, Ltd
This book represents the fruit of a conference held in Oxford on March 3, 2006 under the auspices of the Institute of European and Comparative Law in the Oxford University Law Faculty. Directive 2005/29 is an important new measure in the construction of a legal framework apt to promote an integrated economic space in the European Union. It establishes a harmonised regime governing the control of unfair commercial practices. As such it represents an important exercise in the use of new rules and new techniques, and therefore poses new challenges to EU lawyers. The purpose of this book is to inform and to explore the issues raised by the Directive, issues which are of academic and practical interest, in helping to understand the evolution of European consumer law within the broader programme of European market regulation. The intense practical significance of this Directive, which heralds a new regime, is likely to provoke commercial operators to seek to exploit opportunities to pursue practices previously suppressed.

Trade and Environment in the EC and the WTO
By: Wiers, J.
Published by: Europa Law Publishing
Is a country allowed to prohibit the use of metal beverage cans if it hampers trade from other countries? Can a country impose gasoline quality standards that allow foreign refiners less possibilities to adapt to these standards than domestic refiners? Can it require all wood products sold on its market to carry a label indicating whether they have been sustainably produced or not? These are just some of the questions that have arisen in recent years over the interpretation of trade liberalisation commitments and environmental concerns. This study describes and compares the rules of the European Community and the World Trade Organisation on the liberalisation of trade in goods and measures taken by the members of these organisations for the protection of the environment. It analyses the interpretation of these rules by the European Court of Justice and WTO panels and the Appellate Body, placing them in their institutional context and comparing them. Attention is paid to how the rules relate to Community and international harmonisation, and to the status of trade-restrictive measures that are based on environmentally damaging production methods. This book thus provides useful insights for academics, policy-makers and those who influence policy alike.

US Financial Regulation and the Level Playing Field
By: Garten, Prof Helen; Shaw, Timothy M.
Published by: Palgrave
What will deregulation and globalization of financial markets mean for the future of US financial regulation? This book argues that the uniqueness of US regulation derives from its success in promoting four principles of competitive fairness that US players demand from financial markets. The peculiar US notion of a 'level playing field' provides a novel approach to understanding the evolution of US regulation, including recent reform, and to predicting US attitudes toward questions of global financial market supervision.
