The Concept of Constituency
By: Rehfeld, Andrew
Published by: Cambridge University Press

This book focuses on a theoretical and historical treatment of the electoral constituency. It argues for a novel alternative - randomly assign all voters into 435 electoral constituencies around the nation in which they would remain for life. The main purpose is to offer a sustained justification for the electoral constituency itself. more...

The Constitution As Political Structure
By: Redish, Martin H.
Published by: Oxford University Press - USA

Over the last forty years modern constitutional scholarship has concentrated on an analysis of rights, while principles of constitutional law concerning the structure of government have been largely downplayed. The irony of this interpretive emphasis is that the body of the Constitution contains relatively little dealing directly with rights. Rather, it is primarily a blueprint for the establishment of a complex form of federal-democratic structure. This work emphasizes the central role served by the structural portions of the Constitution. Redish argues that these structural values were designed to provide the framework in which our rights-based system may flourish, and that judicial abandonment of these structural values threatens the very foundations of American political theory.  more...

Constitutional Reform in the United Kingdom
By: Beatson, Jack
Published by: Hart Publishing, Ltd

The Labour Government's proposals for reform of the UK's internal constitutional arrangements promise the most wide-ranging and substantial overhaul of the constitution this century. Their plans, which include devolution for Scotland and Wales, incorporation of the ECHR, a Freedom of Information Bill and reform of both houses of Parliament are already far progressed, but critical choices have still to be made. Against this background, and in view of these historical events, the Directors of the Centre for Public Law at the University of Cambridge recently organised a major conference to discuss the legal and practical implications of the proposed reforms. Speakers at the conference included leading academics, barristers, solicitors, judges and politicians. The results, which are reproduced in this volume of conference proceedings, will be essential reading for all those interested in constitutional reform and in British political history. more...

Constitutionalism and Legal Reasoning
By: La Torre, Massimo
Published by: Springer

Talks about the search of a model for a humane law - where the cruelty ban is still in force. Presenting the contention that positive law is better understood, if it is not too easily equated with power, force, or command, this book shows that law is more a matter of discourse and deliberation, than of sheer decision or of power relations. more...

Constructing Civil Liberties
By: Kersch, Ken I.

Contemporary Paganism
By: Barner-Barry, Carol
Published by: Palgrave Macmillan

This book explores the legal bias in the United States against Paganism and other non-Christian religions. Despite being one of the most religiously diverse countries in the world, the U.S. legal system developed when the population was predominantly Christian. Built into the law is the tacit assumption that all religions and religious practices resemble Christianity. Using the Pagans as a case study, Barner-Barry shows how their experiences demonstrate that both the law affecting nondominant religions and the judiciary that interprets this law are significantly biased in favor of the dominant religion, Christianity. This creates legal problems, as well as problems of intolerance, for religions with significantly different practices. Special attention is given to a series of Supreme Court decisions interpreting the Freedom of Religion Clause in terms of neutrality and interpreting the Establishment Clause loosely and its impact on nondominant religions in the US. more...
